Terms of Service

Effective date: October 8, 2026

These Terms of Service (“Terms”) govern your use of StreamSpark at streamspark.ai and its tools (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and accounts

  • You must be at least 13 years old (or the minimum age required in your country) to use the Service.
  • You are responsible for the information you provide, for keeping your password secure, and for all activity under your account.
  • Let us know right away if you believe your account has been accessed without permission.

2. The Service

StreamSpark provides AI-powered tools for creators, including thumbnail audits, Similar Thumbnails comparisons, YouTube and Twitch title/description/hashtag generation, social post generation, and channel insights for connected YouTube and Twitch channels. We may add, change or remove features at any time.

AI output is guidance, not a guarantee. Scores (including the YouTube Readiness Score), suggestions and generated content are AI opinions based on general best practices. Similar Thumbnails match scores, best-time estimates and niche trends are likewise estimates. They are not YouTube or Twitch metrics and do not guarantee views, clicks, subscribers or any other result. AI can make mistakes — review all output before you use it. The real measure of performance is your own analytics, such as click-through rate in YouTube Studio.

3. Your content

  • You keep ownership of the thumbnails and text you submit (“Your Content”) and of the content we generate for you.
  • You grant us a limited license to store, process and transmit Your Content only as needed to operate and provide the Service to you.
  • You confirm you have the rights to everything you upload, and that it does not infringe anyone else’s rights or break any law.
  • You are responsible for how you use generated content, including making sure it complies with the rules of the platforms where you post it.

4. YouTube and Twitch connections

Connecting a YouTube channel is optional. StreamSpark uses YouTube API Services with read-only access. By connecting your channel you agree to be bound by the YouTube Terms of Service, and Google’s handling of your data is governed by the Google Privacy Policy. How we use YouTube data is described in our Privacy Policy. You can disconnect at any time.

Connecting a Twitch channel is also optional and read-only. By connecting it you agree to the Twitch Terms of Service. You can disconnect at any time.

5. Acceptable use

You agree not to:

  • Upload content that is illegal, infringing, hateful, sexually explicit involving minors, or otherwise harmful.
  • Use the Service to create spam, deceptive or misleading content, or to violate any platform’s rules.
  • Attempt to access other users’ accounts or data, or probe, scan or disrupt the Service.
  • Scrape, resell or automate access to the Service, or get around usage limits.
  • Reverse engineer the Service except where the law allows it.

We may limit, suspend or terminate access for anyone who violates these Terms.

6. Free plan and usage limits

  • Every account includes 3 free thumbnail audits per calendar month (US Eastern Time), plus 1 free improved-version audit per original thumbnail. Unused free audits do not carry over.
  • Deleting an audit does not restore a free audit, credits or pack audits used for it.
  • To keep the Service fast and fair for everyone, we also apply reasonable rate limits (for example, a number of generations or searches per hour). These limits may change over time.

7. Paid plans, credits and billing

Plans and credits

  • Paid plans are Standard (US$10/month, 10,000 credits per billing period) and Pro (US$20/month, 20,000 credits per billing period). Current prices and credit costs per action are shown on our Pricing page.
  • Credits are used for paid features (for example thumbnail audits beyond your free allowance, content generators and niche trend refreshes). Free monthly audits are always used before credits.
  • Plan credits reset at the start of each billing period. Unused credits do not roll over, have no cash value, and cannot be transferred.
  • If an AI request fails and produces no result, the credits or audit charged for it are returned to your balance.

Subscriptions, renewal and cancellation

  • Subscriptions renew automatically every month and your payment method is charged at the start of each billing period until you cancel.
  • You can cancel any time from Plans & Billing. Cancellation takes effect at the end of your current billing period; you keep paid features and remaining credits until then, and you will not be charged again.
  • Upgrading from Standard to Pro takes effect immediately. You are charged a prorated amount for the rest of the current period and your credits are topped up to 20,000.
  • Downgrading from Pro to Standard takes effect at the end of the current billing period.
  • Deleting your account cancels any active subscription immediately, and remaining credits and pack audits are forfeited.

Audit Credit Pack

  • The Audit Credit Pack is a one-time purchase of US$5 for 10 thumbnail audits, available on any plan.
  • Pack audits can be used only for thumbnail audits, not for generators or other features. They do not expire while your account exists and are used after your free allowance and plan credits.

Payments, failed payments and refunds

  • Payments are processed by Stripe and are subject to Stripe’s terms. Prices are in US dollars and may not include taxes that apply where you live.
  • If a renewal payment fails, your subscription may be marked past due and paid features may be paused until payment succeeds. If payment is not completed, the subscription will be cancelled and your account will return to the Free plan.
  • Except where required by law, payments are non-refundable, including for partially used billing periods, unused credits and unused pack audits. If you believe you were charged in error, contact us within 30 days and we will review it.
  • We may change prices or credit costs. Price changes for existing subscriptions will be announced at least 30 days in advance and apply from your next billing period; you can cancel before then.

8. Our intellectual property

The Service, including its design, software, branding and the StreamSpark name and logo, belongs to StreamSpark and is protected by law. These Terms don’t give you any right to use our branding.

9. Termination

You can stop using the Service and delete your account at any time from Account Settings. We may suspend or end your access if you violate these Terms or if we discontinue the Service. If we discontinue the Service, we will cancel active subscriptions and refund any prepaid, unused portion of the current billing period. Sections that by their nature should survive termination will survive.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee the Service will be uninterrupted, error-free or that results will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, StreamSpark will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, views or audience, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or US$50 if you have not paid us anything.

12. Changes to these Terms

We may update these Terms from time to time. We will update the effective date above and, for significant changes, notify you through the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
